Terms of Service

1. Acceptance of Terms

By accessing or using Xpendee at https://xpendee.com, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the platform.

These Terms constitute a legally binding agreement between you and Finity Sync.

2. Eligibility

You must be at least 18 years of age to use Xpendee. By using the platform, you represent and warrant that you are 18 or older and legally capable of entering into binding contracts under applicable Pakistani law.

3. Description of Service

Xpendee is a B2B SaaS platform designed for freelancers and agencies. It provides the following features:

  • Invoice creation and management (PKR and USD)
  • Contract creation with OTP-based e-signature
  • Proposal management
  • Expense and P&L tracking
  • White-label client portals
  • Freelancer and project management

4. Account Registration and Security

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to provide accurate and complete registration information.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately at support@finitysync.com if you suspect unauthorized access to your account.
  • Finity Sync reserves the right to suspend or terminate accounts that violate these Terms.

5. Subscription and Payment

5.1 Subscription Plans

Access to Xpendee is available through paid subscription plans as displayed on the platform.

5.2 Payment Method

All subscription payments are made via manual bank transfer to Finity Sync's designated bank account. Details are provided in the platform's billing section.

5.3 Payment Verification

After making a bank transfer, you must upload your payment proof (screenshot or receipt) within the platform. Your subscription will be activated upon manual verification and approval by Finity Sync.

5.4 Refund Policy

All payments are non-refundable unless explicitly agreed otherwise in writing by Finity Sync. If a payment is not approved, the amount will be returned to the original account within a reasonable timeframe.

6. Acceptable Use

You agree not to:

  • Use Xpendee for any illegal, fraudulent, or unauthorized purpose
  • Create fake invoices, contracts, or financial records intended to deceive
  • Attempt to hack, reverse engineer, or gain unauthorized access to any part of the platform
  • Upload malicious files or content
  • Violate the intellectual property rights of Finity Sync or any third party
  • Impersonate another person or entity

Violation of these rules may result in immediate account termination without refund.

7. Client Data and Tenant Responsibility

  • As a Tenant, you are responsible for the accuracy and legality of the client data you enter into Xpendee.
  • You represent that you have obtained necessary consent from your clients to store their information on the platform.
  • Finity Sync is not responsible for the content of invoices, contracts, or proposals created by Tenants.

8. E-Signatures

Xpendee provides OTP-based e-signature functionality for contracts. By using this feature:

  • You acknowledge that e-signatures generated through Xpendee are intended to serve as binding electronic signatures.
  • The legality of electronic signatures in your jurisdiction is your responsibility to verify.
  • Finity Sync stores signature data (name, email, timestamp, and signature image) as evidence of the signing event.

9. Intellectual Property

  • All platform code, design, branding, and content of Xpendee is the intellectual property of Finity Sync.
  • You are granted a limited, non-exclusive, non-transferable license to use the platform for its intended purpose.
  • You may not copy, reproduce, distribute, or create derivative works from any part of Xpendee without written permission from Finity Sync.

10. Availability and Downtime

  • We strive to maintain platform availability but do not guarantee uninterrupted access.
  • We are not liable for losses resulting from planned or unplanned downtime, server maintenance, or hosting issues.

11. Limitation of Liability

To the maximum extent permitted by Pakistani law:

  • Finity Sync is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use Xpendee.
  • Our total liability for any claim shall not exceed the amount you paid to us in the 30 days prior to the claim.

12. Termination

  • You may terminate your account at any time by contacting support@finitysync.com.
  • Finity Sync may suspend or terminate your account at any time for violations of these Terms, non-payment, or any other reason at our discretion, with or without notice.
  • Upon termination, your data may be retained for up to 90 days before permanent deletion.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Islamic Republic of Pakistan. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Pakistan.

14. Changes to Terms

We reserve the right to update these Terms at any time. Updated Terms will be posted on this page with a new effective date. Continued use of Xpendee after changes constitutes your acceptance of the updated Terms.
